Notice of BOC Group Life Assurance Company Limited concerning the Personal Data (Privacy) Ordinance (Tied Agents Version)

Please read this Notice before provide any personal data to BOC Group Life Assurance Company Limited (referred to as “the Company”, “our”, “we”, or “us”)

In order to comply with the provisions of the Personal Data (Privacy) Ordinance and other related ordinances, and for the purpose of protecting personal privacy, we have specifically prepared this Notice which sets out our basic policies regarding the collection, storage, use and security of the personal data of tied agents. 1. Types of personal data collect and held by us regarding tied agents and the purposes of use of such data
   1. We may collect certain personal information from you when you apply to be an insurance agent with us, including but not limited to your name, identity card number, passport number, date of birth, photograph(s), contact information, financial and account information, academic and professional qualifications, compensation, and employment history (“Personal Data”). We may also collect Personal Data about you from third parties such as other insurance companies or agents, educational institutions, government agencies, credit reference agencies, investigation agencies, courts or public records.
   2. The types of Personal Data held by us regarding tied agents include: the basic personal information of tied agents, curriculum vitae, information about allowances and benefits, bank account information, personal credit information, internal and external training records or information at the Company, promotions, work experience, appraisals, attendance information, reward and disciplinary record at the Company and etc., and other Personal Data collected for purposes listed in 1(c).
   3. The Company collects and holds the above-mentioned Personal Data for the following purposes:
      1. to consider your suitability as a tied agent;
      2. to register you as a tied agent and to manage the tied agency relationship;
      3. to communicate with you;
      4. to pay commission and other compensation;
      5. for business planning and performance review;
      6. for research and statistical analysis;
      7. for benefit management and administration;
      8. for training and development (including managing and recording the continuing professional development of licensed insurance intermediary and registered MPF intermediary required by regulators);
      9. to provide references;
      10. to take any action arising out of, or in connection with, your appointment; and
      11. to execute disciplinary system for tied agent and to detect fraud and criminal activities;
   4. We will from time to time review the use of Personal Data of tied agents held by us so as to ensure that such use does not violate the original purpose.
2. Persons/organizations having the right to use the Personal Data (Post-termination included)
   1. For the purposes listed under “Types of personal data collect and held by us regarding tied agents and the purposes of use of such data”, the Company may disclose your Personal Data to following third parties (within or outside Hong Kong):
      1. our holding companies (including those located outside Hong Kong), Bank of China (Hong Kong) Limited and its subsidiaries (including those located outside Hong Kong);
      2. our third-party service providers (including without limitation the insurers, bankers, lawyers, accountants, continuing professional training course providers, and other third-party service providers who provide administrative, telecommunications, computer, payment or other services to us to enable us to operate our business);
      3. industry associations and federations;
      4. regulators and government agencies;
      5. credit reference agencies;
      6. debt collection agencies;
      7. law enforcement agencies;
      8. the Courts;
      9. educational institutions;
      10. our tied agency force; and
      11. any other person under a duty of confidentiality to the Company which has undertaken to keep such information confidential.
3. Responsibility to provide Personal Data
   1. When you provide Personal Data to us, please ensure that the Personal Data provided are complete, correct and accurate.
   2. If you do not provide the Personal Data we need, we will not be able to commence various activities listed under “Types of personal data collect and held by us regarding tied agents and the purposes of use of such data” for you, and the tied agency relationship between you and us may also be affected.
   3. Should any Personal Data provided by you become inaccurate or obsolete, you are obliged to inform us as soon as possible. We shall not be responsible for any mistaken outcomes or any consequences as a result of Personal Data being inaccurate when you provided it to us, or your failure to promptly seek to correct any obsolete data.
4. Security policy concerning personal data
   1. We will take practicable steps to ensure that the Personal Data that we collect and hold are accurate.
   2. Unless otherwise provided herein, or your consent has been obtained and the requirements of relevant ordinances and regulations are satisfied, your Personal Data will not be used for any purpose that is not related to those listed under “Types of personal data collect and held by us regarding tied agents and the purposes of use of such data”.
   3. We will provide suitable training and guidance and take practicable steps to increase the awareness of staff and tied agent towards the protection of Personal Data, and to ensure that the Personal Data held by us will be protected without being subject to unauthorized or accidental access, use or deletion.
   4. Upon the completion of the purposes listed under “Types of personal data collect and held by us regarding tied agents and the purposes of use of such data”, although no employment relationship exists between the tied agent and the Company, the Company will still destroy the tied agent’s Personal Data in accordance with the “Code of Practice on Human Resources Management” issued by the Office of the Privacy Commissioner for Personal Data, Hong Kong.
5. Access and correction rights
   1. You have the right to enquire whether we hold any Personal Data relating to you, and request access to such data (if any).
   2. If you think that the Personal Data held by us is not correct, you can request us to make correction.
   3. According to the Personal Data (Privacy) Ordinance, we have the right to charge a reasonable fee for handling any request for access to Personal Data.
   4. Subject to the provisions of the Personal Data (Privacy) Ordinance, we will comply with your requests for access to or correction of your Personal Data.

I acknowledge that I have read the Notice of BOC Group Life Assurance Company Limited to Tied Agents concerning the Personal Data (Privacy) Ordinance (“the Notice”), I understand BOC Group Life Assurance Company Limited’s policy on the protection of personal data and my rights to access and correct my personal data. I further acknowledge and consent that my personal data may be disclosed to, or held, used, transferred, and processed in accordance to the Notice.
