1. About these Terms of Use

These Terms of Use sets out the terms of use governing your registration and/or use of BOC Life “Live Young” Rewards Program (“Rewards Program”) managed by BOC Group Life Assurance Company Limited ("BOC Life" or “We”). By accessing the Rewards Program official site and/or membership registration portal and/or enjoying the relevant services, you acknowledge that you have read, understood and confirmed these Terms of Use and agree to be bound by all amendments, additions and modifications to them. These Terms of Use may be revised at any time by updating this page. You are bound by any such revisions and should therefore periodically visit this page to review the latest Terms of Use.

2. Governing Law and Jurisdiction

These Terms of Use are governed by and will be construed in accordance with the laws of the Hong Kong Special Administrative Region (“Hong Kong”) and you agree to submit to the exclusive jurisdiction of the courts of Hong Kong.

If for any reason, any provision or part of these Terms of use is found to be void or unenforceable, such provision or part of these Terms of use shall be deemed to be severed from these Terms of use and the remainder of such provision or part of these Terms of use, as the case may be, shall remain in full force and effective and may be enforced to the fullest extent possible.

Chinese version of these Terms of Use is for reference only. In case of inconsistency between the English and Chinese versions of these Terms of Use, the English version shall prevail. In the event of dispute, the decision of BOC Life shall be final and conclusive.

3. Disclaimer

BOC Life does not warrant the absence of delays, failures, errors, omissions or loss in respect of any information transmitted through the official site and/or membership registration portal and disclaims its liability for any error in connection, interruption, delay in operation or incomplete transmission, line or system failure. BOC Life does not guarantee any of the following:

(a) no viruses or other contaminating or destructive properties will be transmitted through the official site and/or membership registration portal; or

(b) no damage will occur to any computer system connecting to the official site and/or membership registration portal. In using the official site and/or membership registration portal, you shall have sole responsibility in protecting and backing up your data and/or equipment; and in taking any precautionary measures against computer viruses or other contaminating or destructive properties as you think appropriate and necessary.

To the fullest extent permissible pursuant to applicable law:

(a) the materials on the official site and/or membership registration portal are provided "as is" basis and without warranties of any kind either expressed or implied and BOC Life disclaims all warranties, expressed or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose, and may be changed at any time without prior notice;

(b) BOC Life does not warrant that the official site and/or membership registration portal (including materials on, and functions of, the official site and/or membership registration portal) will be uninterrupted or error-free, that defects will be corrected, or that the official site and/or membership registration portal or the server that makes it available are free of viruses or other harmful components; and

(c) BOC Life does not warrant or make any representations regarding the use or the results of the use of the materials on the official site and/or membership registration portal in terms of their correctness, accuracy, reliability, or otherwise. BOC Life accepts no liability and will not be liable for any loss or damage arising directly or indirectly (including special, actual or contingent, incidental or consequential loss or damage) from your use/access to the official site and/or membership registration portal, howsoever arising, including any loss, damage or expense arising from, but not limited to, any defect, error, imperfection, fault, mistake or inaccuracy of or in connection with the official site and/or membership registration portal, the contents or associated services, or due to any unavailability or delay of any contents or associated services or any part thereof, or your dealings with third party product/service providers.

4. Health information, exercise and workout guide provided under this Rewards Program

Please note that the material (including, without limitation, workout and exercise tips, and information contained in mobile applications and video clips), including all text, photographs, images, illustrations, graphics, audio, video and audio-video clips, is provided by way of information only, and they do not constitute and must not be used as a substitute for medical advice, diagnosis or professional advice. Whilst we endeavour to ensure that the contents of the material are accurate, errors or omissions may occur and we do not accept any liability in respect of them.

BOC Life recommends that you consult with your physician before you undertake to follow any health information, exercise and workout tips you may receive from this Rewards Program. BOC Life is not a licensed medical provider and has no expertise in diagnosing, examining, or treating medical conditions of any kind, or in determining the effect of any specific exercise on a medical condition. The information available in this Rewards Program is not intended to be a substitute for professional medical advice, diagnosis, treatment or management of care following an assessment in the event of abnormal health screen results. You should not change or discontinue any assistance or treatment you may be receiving on the basis of information provided in relation to any benefits, devices, services, software available or tools accessed or used without first consulting your healthcare provider. Information provided through this Rewards Program is general information only and does not take into account your personal circumstances, and is subject to change. Should you have any health related questions or have an emergency, please call or see your healthcare provider promptly. This Rewards Program may provide you with health indicators and various wellbeing, health condition and similar information based on your information provided and your circumstances; such information is provided for reference only, and it is not intended to substitute the expertise and judgment of any doctor, pharmacist or other healthcare professional.

Please consult your health care professional with any questions or concerns regarding the exercise and workout guide provided by this Rewards Program, or before starting any exercise or workout. You expressly agree that your activities carry certain inherent and significant risks of property damage, bodily injury or death and that you voluntarily assume all known and unknown risks associated with these activities even if caused in whole or part by the action, inaction or negligence on the part of BOC Life, Partners and/or others. You also expressly agree that we do not assume responsibility for the inspection, supervision, preparation, or conduct of any race, contest, group athletic activity or event that may earn you rewards or benefits in this Rewards Program.

Not all exercise and workout mentioned in this Rewards Program are suitable for all persons. If you ever start to feel unwell or have discomfort at any time after trying the workout or exercise, stop immediately and seek further advice from your healthcare professionals.

You may have access to other people’s health, wellbeing and similar data in this Rewards Program but you should not disclose the same without their express authorization and permission.

To the extent permitted by law, BOC Life excludes any and all liability to you under contract, tort, statute, equity or in any other manner, for any injury (including without limitation death, personal, bodily or mental injury), damage or loss of any kind whatsoever (including without limitation, any liability for direct, indirect, special or consequential loss or damage) sustained by you or any other person, or for any costs, charges or expenses incurred by you or any other person arising from or in connection with any use or misuse of or interpretation or reliance on the information provided in this Rewards Program (including, without limitation, health information, exercise and workout guide, and information contained in video clips)

The above terms are also applicable to the health information, exercise and workout guide provided by the platforms of Partners (including but not limited to any website, application and/or communication channel operated and used by Partners).

BOC Life is not responsible for any information relating to this Rewards Program provided by the platforms of Partners.

5. Member ID of this Rewards Program, Internet Security and Online Instructions

The membership registration portal is for your sole and exclusive use. You must keep your member ID and password strictly confidential and use with all reasonable care at all times. You shall bear the risk of any unauthorised use of your password, no matter whether your password was emailed to you or set by you. You shall not in any circumstances disclose your member ID and password to any other person to use the official site and/or membership registration portal. BOC Life shall not be responsible or liable for any harm or loss you may suffer as a result of an unauthorized use of your member ID and password.

Any instruction given by the use of your password is valid and binding on you.

You will be liable for all losses if you have acted fraudulently or with gross negligence, or allowed any third party to use your password or failed to comply with your obligation under this Section 5.

You agree that you are solely responsible for ensuring that your equipment or device (including software programs contained thereon) are capable of and in good functioning order for accessing the official site and/or membership registration portal and for maintaining security of your equipment or device.

By accessing and using the official site and/or membership registration portal, you acknowledge and accept that the inherent risks in the use of and transmission of information via the internet, and you also agree to take all reasonably practicable measures to ensure and maintain the security of your equipment and device for accessing the official site and/or membership registration portal.

Messages shown on or printed out from your computer or other equipment are for your reference only.

BOC Life may download information including identification data to your computer or equipment.

Records will only be retained on the official site and/or membership registration portal for the period determined by BOC Life.

The official site and/or membership registration portal are hosted by BOC Life and may be connected to the internet via an independent service provider, who is not an agent of BOC Life and for whom BOC Life is not responsible. BOC Life will use reasonable care in selecting the service provider. The official site and/or membership registration portal and the information on them may be changed by BOC Life at any time without notice.

BOC Life will only record your visit by recording your domain name server address and the pages you visited, and this process will not involve collection of personal information unless otherwise specified. Only the numbers and types of browser will be shown in statistics of BOC Life in respect of the use of the official site and/or membership registration portal.

Upon use of your password or your email address on record to access the official site and/or membership registration portal, BOC Life is authorised to act on the received instructions and you agree that:

(a) BOC Life is authorised to act on any online instructions which BOC Life in our sole discretion believes emanate from you, based on use of your password or your email address on record for the office site and/or membership registration portal. All online instructions will be valid and binding on you and BOC Life shall not be liable for acting in good faith on online instructions which emanate from any unauthorised person(s). BOC Life shall not be under any duty to verify the identity of the person(s) giving online instructions purportedly in your name, where your email address on record or your password for the official site and/or membership registration portal are used;

(b) you shall keep BOC Life indemnified at all times against, and to keep BOC Life from, all action, proceedings, claims, losses, damages, costs and expenses which may be brought against BOC Life or suffered or incurred by BOC Life and which may have arisen either directly or indirectly from or in connection with BOC Life accepting online instructions and acting or failing to act thereon unless due to the wilful default of BOC Life. Such indemnity shall continue notwithstanding the expiry or termination of your Rewards Program membership; and

(c) your right to use the official site and/or membership registration portal pursuant to the Terms of Use herein shall at all times be subject to the discretion of BOC Life, and BOC Life may at any time revoke such right and/or terminate the official site and/or membership registration portal without prior notice.

6. Third-Party Links

The official site and/or membership registration portal may be linked to other websites, mobile applications and/or communication channels which are not maintained by BOC Life, which are provided for your connection only. BOC Life is not responsible for the content of those websites, mobile applications and/or communication channels and have not verified them. The inclusion of any link to such websites, mobile applications and/or communication channels do not imply approval of or endorsement by BOC Life of such websites, mobile applications and/or communication channels or the content thereof. You acknowledge and agree that you access such websites, mobile applications and/or communication channels at your own risk. BOC Life has no control over such websites, mobile applications and/or communication channels and accepts no responsibility or liability in respect of them.

7. Copyright and Trademarks

BOC Life and other parties own the trademarks, logos and service marks displayed on the official site and/or membership registration portal. These may not be used without the written permission of BOC Life or the party owning these.

Materials on the official site and/or membership registration portal are protected by copyright. No part of these materials may be modified, reproduced, stored in a retrieval system, transmitted, copied, distributed or used in any other way for commercial or public purposes without BOC Life and or other parties' prior written consent.
